Welcome to MusDiary. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using MusDiary, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

  • Provide accurate and complete information when creating your profile
  • Keep your account information up to date
  • Notify us immediately of any unauthorized use of your account
  • Be at least 13 years old to use our services

3. Content Ownership and Rights

You retain ownership of all content you upload to MusDiary, including but not limited to:

  • Audio recordings
  • Video recordings
  • Images and photographs
  • Written content (diary entries, descriptions, etc.)
  • Musical compositions and arrangements

Important: Content Rights Requirement

You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content you upload to MusDiary. This includes:

  • Performance rights for recorded music
  • Copyright permissions for compositions by other composers
  • Sync rights for audio/video recordings
  • Rights to use any samples, loops, or third-party materials
  • Permission from any collaborators featured in your content

You are solely responsible for ensuring you have the legal right to upload and share all content on the platform. MusDiary is not liable for any copyright infringement or rights violations in user-uploaded content.

By uploading content to MusDiary, you grant us a limited, non-exclusive, royalty-free license to host, store, and display your content as necessary to provide our services to you and your audience.

4. Prohibited Conduct

You agree not to:

  • Upload content you do not have the rights to share
  • Upload content that infringes on intellectual property rights
  • Upload illegal, harmful, threatening, abusive, or offensive content
  • Impersonate any person or entity
  • Spam, harass, or harm other users
  • Attempt to access unauthorized areas of the platform
  • Use the platform for any illegal purpose

5. Fan Membership and Payments

Musicians may offer a paid membership to their audience and display PayPal Buy Now buttons. Musicians must use their own PayPal account—MusDiary does not process payments on behalf of musicians. Important details:

  • Each musician is the legal seller and must have their own PayPal business account
  • Musicians can edit or remove their membership at any time
  • Refunds, delivery of goods or services, customer support, tax compliance, and adherence to legal regulations are the musician's sole responsibility
  • MusDiary receives PayPal Instant Payment Notification (IPN) webhooks to verify subscriptions and grant fans access to members-only content. Musicians must configure the IPN URL in their PayPal account settings (instructions provided on the membership setup page)

6. Refund Policy

MusDiary Subscription ($14.95/month):

Refunds for the MusDiary platform subscription are provided on a case-by-case basis within 7 days of payment. To request a refund, contact us at info@musdiary.com with your account details and reason for the refund request.

Musician Memberships and Physical Items:

MusDiary does not process payments for musician memberships or physical items sold through PayPal Buy Now buttons. All transactions are handled directly between musicians and their supporters through PayPal. Refund requests for these purchases must be directed to the individual musician, as they are the legal seller and are responsible for their own refund policies.

7. EU VAT Information

If you are located in the European Union:

  • VAT will be applied to your subscription unless you provide a valid EU VAT ID at the time of purchase.
  • By entering a valid VAT ID, you confirm that you are a registered business and that the information provided is accurate.
  • VAT-registered customers are responsible for self-assessing any reverse-charge VAT obligations in their own country.

8. Content Moderation

MusDiary reserves the right to review, remove, or restrict access to any content that violates these Terms or is reported by users. We may suspend or terminate accounts that repeatedly violate our policies.

9. Disclaimer of Warranties

MusDiary is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, or error-free. You use the platform at your own risk.

10. Limitation of Liability

MusDiary and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of revenue, data, or content.

11. Copyright Infringement

We respect intellectual property rights. If you believe content on MusDiary infringes your copyright, please contact us with:

  • Description of the copyrighted work
  • Location of the infringing content on our platform
  • Your contact information
  • A statement of good faith belief that the use is not authorized

12. Termination

You may terminate your account at any time through your settings. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or platform notification. Continued use of MusDiary after changes constitutes acceptance of the updated Terms.
